Abstract

Fazlur Rahman is one of the excellent scholars whose ideas in Islamic Studies cover many different kinds of disciplines. Due to his great contribution to the development of Islamic Studies, a number of researchers have conducted some studies on his thoughts. As far as Rahman is conducted, he paid his attention of study more seriously on Islamic law, including Islamic legal theories (usul figh). Therefore, a number of his works, either book or separate articles, discuss about usul fiqh, in which he has made some contributions. Among his contributions in contemporary ushul fiqh, the writer considers that two of them are very interesting to study. First, he offers to employ an integrative approach in studying Islamic teachings by looking at al-Qur'an and the tradition of the prophet. Second, he distinguishes nash into two: normative-universal and practice-temporal one. This article is trying to elaborate his great ideas on contemporary usul fiqh.

Abstract

Pada dekade tahun 1980-an, isu perayaan Natal bersama (common Christmas celebration) antara umat Kristiani dengan sebagian umat Islam mencuat ke permukaan dan menjadi masalah kontroversial di kalangan umat Islam. Para pemuka agama Islam (ulama') memperdebatkan tentang boleh tidaknya seorang Muslim mengikuti perayaan Natal bersama. Pertentangan tersebut timbul karena belum adanya ketetapan hukum Islam yang secara khusus mengatur peran Serta umat Islam dalam Perayaan Natal bersama. Untuk menjaga kemurnian akidah umat Islam, Majelis Ulama Indonesia (MUI) mengeluarkan fatwa berkenaan dengan perayaan Natal bersama yang intinya mengharamkan umat Islam mengikuti upacara Natal bersama. Namun, fatwa tersebut justru mengundang reaksi dari berbagai kalangan. Reaksi keras muncul dari pemerintah Orde Baru yang pada saat itu sedang giat-giatnya mengkampanyekan Trilogi Kerukunan Beragama yang digagas oleh Menteri Agama, H. Alamsyah Ratuperwiranegara. Reaksi keras dari pemerintah tersebut akhirnya mendorong Prof. Dr. HAMKA mengundurkan diri dari jabatan ketua umum MUI. Di samping reaksi dari pemerintah, reaksi terhadap fatwa juga muncul dari umat Islam sendiri secara perorangan baik yang bernada positif (mendukung) maupun yang bernada negatif dan skeptif. Fatwa MUI ini secara nyata merefleksikan hubungan antara umat Islam dan umat Kristiani yang mengalami fluktuasi dari masa ke masa.

Abstract

The hardest economic problem faced by human being is the instability or the fluctuation of prices. This phenomenon is closely related to inflation, i.e., the uprising of prices continuously, or the decrease of the value of a currency toward goods and services. As an example, someone borrowed to someone else as much as 1 million rupiahs and returned it back two years later with the same amount. Due to the inflation during that period, the value of 1 million rupiahs in the time of transaction is very different from that in the time of return. This problem has been becoming one of the polemics among fuqaha, either in the medieval era or in the modern one. This article is trying to observe the problem more objective without relying on a certain school of Islamic jurisprudence (madhhab), and providing the best ijtihad derived from certain fuqaha. Some considerations to decide which would be the best ijtihad are the arguments on which the fuqaha’s based on their decision. Besides, the writer also takes into account some norms of Islamic jurisprudence: taysir (to take it easily) and 'adamul haraj (to exclude obstacles). Finally, the writer offers some discussion on the issue among contemporary fuqaha.

Abstract

Sejak ijtihad dinyatakan ditutup oleh para ulama pada abad pertengahan, berbagai fenomena taqlid menjadi dominan di negara negara Muslim. Hal ini pulalah yang kemudian ikut berperan dalam menjadikan terpuruknya negara-negara Muslim, baik secara sosial maupun politik. Shah Wali Allah yang kita kenal sebagai pembaharu Islam di India, ternyata memulai pembaharuannya di bidang Fiqh. Pemerintahan Mughal India oleh Shah Alam Bahadur Shah, anaknya Awrangzeb, mengalami masa krisis sehingga banyak terjadi konflik yang menyebabkan kemunduran Islam dalam percaturan politik. Shah Wali Allah akhirnya tampil dan melakukan banyak pembaharuan, terutama pembaharuan pemikiran dalam Islam. Di antara pembaharuan Shah Wali Allah yang terkenal adalah dibukanya ijtihad untuk menghilangkan berbagai taqlid yang ada pada umat Islam. Artikel ini berusaha untuk melihat lebih dekat pada konsep ijtihad dan taqlid yang ditawarkan oleh Shah Wali Allah. Selain itu, akan dilihat pula latar belakang sosial dan politik yang sangat berpengaruh terhadap konsep-konsep pembaharuan Shah Wali Allah.

Abstract

Arabic (language) is not something new for Indonesian Muslims. Arabic came along with the arrival of Islam in Nusantara. Since then, Indonesian Muslims learn Arabic in various pesantrens, either traditional or modern one. Although Islam has undergone some major developments in its substance and teachings, Arabic has not undergone such major progress. In other words, most pesantrens still employ classical methods in teaching the Arabic. Few pesantrens, however, have developed their methods of Arabic teaching, particularly modern pesantrens such as Pondok Modem Gontor. According to the writer, it is interesting to study these phenomena by viewing some advantages and disadvantages of employing the new methods of Arabic learning. By taking into account of some significant developments in the teaching methods generally, this article is trying to offer an alternative method of Arabic teaching in a way that Indonesian Muslims could learn Arabic easily.

Abstract

This article tries to describe contemporary Islamic thought in Indonesia, which is influenced by modern and critical social sciences. The Islamic Liberalism is considered by some people as a new school (madzhab) in the Indonesian Islamic thought. What is the relevance of the Islamic Liberalism while Indonesia in economic crisis? Who are the figures of the Islamic Liberalism in Indonesia? The Islamic Liberalism mostly concerned with how Islam deals with modernity such as democracy, pluralism, the state, gender, etc. The methodology of the Islamic Liberalism is to perceive new interpretation toward Islamic doctrine of Al-Qur'an and Hadith, social history and social context of Muslim society by employing the science of language, historical critics and social sciences. Nurcholish Madjid, Qohan Effendy, Abdurrahman Wahid and Ahmad Wahib are among those who set the embryo of the Islamic Liberalism in Indonesia. After them, some young intellectuals from NU, Muhammadiyah and other NGOs have been developing and becoming the avant-gardes of the Islamic Liberalism. They have a distinct thought that is not sectarian, ideological and parochial. How is the future of this new genre of Islamic thought in Indonesia? To understand them, we should have a look at their activities either theoretically (discourses) or practically.

Abstract

Bulan Ramadlan telah usai. Hari Raya Idul Fitri 1423 H dengan pelaksanaan yang berbeda hampir berlalu. Namun, untuk kepentingan jangka panjang, masih ada hal yang harus diselesaikan. Yakni, unifikasi kalender Islam yang bersifat internasional untuk kepentingan peribadatan umat Islam. Dalam kehidupan sehari-hari umat Islam menggunakan kalender Masehi sebagai acuan untuk kepentingan transaksi, perjanjian, dan administrasi. Selain itu, umat Islam juga menggunakan kalender Hijriah untuk penjadwalan waktu ibadah dan hari-hari besar Islam. Untuk itu, umat Islam perlu memahami konsekuensi hidup dalam dua kalender ini, agar bisa memahami mengapa di satu negeri bisa berhari raya lebih dulu atau lebih lambat dari umat islam di lndonesia. Oleh karena itu tinjauan buku ini mencoba menelaah kontribusi buku Mohammad Ilyas yang berjudul Astronomy of Islamic CaJendar.

Abstract

I’jaz  al-Qur'an is one of the important dogma in Islam; it is derived from many Qur'anic verses. The dogma stipulates that the Qur'an is inimitable. But what is inimitable in the Qur'an remains to be discussed among Muslim scholars. At the outset of development of the study of the Qur'an, the classical writers considered the balaghah (rhetorical excellence) of the Qur'an to be its I’jaz. They argue that though the Qur'an did not specify this, one can understand that the Arabs -with all their expertise in the field of literary genre- was challenged to produce a piece of work, as eloquence as the Qur'an. On the other hand, modern writers considered that what is inimitable in the Qur'an was not only its balaghah but also its contents in general, and its messages. The contents and messages of the Qur'an, which are carefully knitted in an excellent balaghah constitute the most Solid materials that are inimitable by anyone. The paper presents, describes, and to some points, compares, the theories of classical and modem writers among Muslim scholars concerning I’jaz aI-Qur'an, to find out the features of modern theories that was not yet elaborated in the classical theories.

Abstract

Karya Wedhatama tergolong karya monomental dalam literatur Jawa. Pada dasarnya ia menggambarkan idiologi dan kehidupan praktis masyarakat Jawa, khususnya di kalangan keluarga keraton. Karena itu tidak mengherankan jika sejumlah sarjana tenama memberi perhatian terhadap karya dimaksud sebagai salah satu sarana memahami falsafah kehidupan orang Jawa. Tulisan berikut bermaksud memberi perhatian sebagaimana para penulis terdahulu, dengan fokus pada pengaruh falsafah Jawa dalam Wedhatama terhadap pemikiran hukum Islam di fawa atau Indonesia pada umumnya. Tulisan ini berkesimpulan bahwa salah satu poin penting kandungan Wedhatama adalah pentingnya perhatian terhadap tradisi setempat (Jawa) bagi kehidupan setiap orang. Pemikiran demikian ternyata sejalan dengan pemikiran ahli hukum Islam kontemporer yang menyatakan bahwa rumusan hukum Islam hendaknya memperhatikan tradisi yang berkembang pada setiap masyarakat termasuk masyarakat Jawa atau Indonesia pada umumnya.
